This statement provides information about how Hutchinson and Harlow Real Estate (HH Real Estate), to the extent that the Privacy Act 1988 (Cth) applies to them, ("we") handles personal information that is provided by a person ("you").
Open Home
It is a condition of entry that, before entering an Open Home, that you provide us with your name, telephone number and any other contact details that we request from you including your email address. If this information is not provided by us, you will be unable to enter an Open Home and we will also be unable to determine or address your interest in the property effectively or at all.
We may collect personal information that you provide us in connection with an Open Home for the following purposes: (a) to ensure the security of an Open Home and the security of any persons who may express interest in or attend an Open Home; (b) to contact you after an Open Home to determine or otherwise address your interest in the property; (c) to contact you after an Open Home to inform you of other properties that we have listed for sale; (d) to provide you with information regarding the property market around your place of residence or, around an Open Home that you attended or expressed interest in; and (e) to give feedback to our client on the interest generated in an Open Home.
Buying or selling a property
We may collect personal information you provide in connection with a property sale agreement (Agency Agreement) or collected from other sources for the following purposes: (a) identifying and verifying your identity and the property; (b) acting on your behalf in accordance with the Agency Agreement; (c) where applicable, advertising, promoting and, otherwise, marketing the property for sale; (d) negotiating any prospective sale of the property; (e) liaising and exchanging information with you, the ultimate purchaser, prospective purchasers, and each of their legal and other advisors in relation to or in connection with any sale of the property; complying with the Agency Agreement, any applicable law and any dispute resolution process; (g) managing, serving and signing (or arranging signing of) the Agency Agreement and managing any sale of the property (including assisting with the exchange of the Agency Agreement and the preparation of any required statements of account); and (h) contacting and liaising with third parties (including, without limitation, goods and services providers and insurers) and to provide those third parties with your personal information.
If you do not provide the personal information outlined in this document or otherwise requested by us, we may not be able to act on your behalf effectively or at all.
We may disclose your personal information for any of the purposes for which it was collected (as outlined above) to other parties including actual or prospective purchasers, our legal and other professional advisors, our existing and potential clients, advertising and media organisations, property data service providers, valuers, parties engaged to evaluate the property, owners’ corporations, financial institutions, real estate professional bodies (which may provide technical and other assistance to us to carry out the matters set out above) and other third parties (including, without limitation, goods and services providers and insurers), government agencies, courts, regulatory bodies, and law enforcement agencies, or as required, authorised or permitted by any applicable law.
We may also use your personal information for marketing and research purposes. You may opt out of receiving marketing communications from us at any time by contacting us using the details below or by using the unsubscribe facility included in electronic communications where available.
HH Real Estate uses third-party suppliers and service providers, including cloud-based software providers, some of which may store or process information outside Australia. Personal information may be disclosed to these providers where reasonably necessary to obtain their services. We seek to ensure that the overseas recipients of your personal information do not breach the privacy obligations relating to that personal information.
